Third Party User's Permission to Use Request

All Cat & Nat Publishing (Thailand) Ltd. logos, service marks, trademarks, trade dress, slogans, copyrighted works and designs (collectively referred to as "Properties") will be used only as explicitly licensed by Cat & Nat Publishing (Thailand) Ltd. and only under the terms and conditions and for the purposes described in our License Agreement. Any and all use by the Third Party User must first be approved and authorized by Cat & Nat Publishing (Thailand) Ltd. Once approval and authorization are granted to the Third Party User, the copyright to all works created by the Third Party User and any and all derivatives of such works belong to Cat & Nat Publishing (Thailand) Ltd.

The Third Party User will ensure that the presentation of Cat & Nat Publishing (Thailand) Ltd.'s Properties will be consistent with Cat & Nat Publishing (Thailand) Ltd.'s own use of the Properties in comparable media. From time to time during the term of the License, Cat & Nat Publishing (Thailand) Ltd. may provide to the Third Party User written guidelines as to the size, typeface, colors, and other graphic characteristics of Cat & Nat Publishing (Thailand) Ltd.'s Properties, which upon delivery to the Third Party User shall be deemed incorporated into the License Agreement.

Cat & Nat Publishing (Thailand) Ltd.'s Properties will not be presented or used: a) in a manner that suggests that the editorial content has been authored by, or represents the views or opinions of Cat & Nat Publishing (Thailand) Ltd. or its representatives, agents, or employees; b) in a manner that is misleading, defamatory, libelous, obscene, infringing or otherwise objectionable; c) in connection with any material that infringes the trademark, copyright or any other rights of any third party; d) as part of a name of a product or service of a company other than Cat & Nat Publishing (Thailand) Ltd.; or e) in a manner that infringes, derogates, dilutes, or impairs the rights of Cat & Nat Publishing (Thailand) Ltd. Cat & Nat Publishing (Thailand) Ltd. shall have complete discretion to evaluate the Third Party User's use and to decide whether that use violates any of the foregoing restrictions.

Any use of Cat & Nat Publishing (Thailand) Ltd.'s Properties shall be to the benefit of Cat & Nat Publishing (Thailand) Ltd. The Third Party User acknowledges Cat & Nat Publishing (Thailand) Ltd.'s ownership of the Properties and warrants against taking any action that is inconsistent with Cat & Nat Publishing (Thailand) Ltd.'s ownership.

The Third Party User will make any changes to its use of Cat & Nat Publishing (Thailand) Ltd.'s Properties as requested by Cat & Nat Publishing (Thailand) Ltd. This remedy is in addition to any other legal remedies to that Cat & Nat Publishing (Thailand) Ltd. may be entitled to in relation to the Third Party User's use of Cat & Nat Publishing (Thailand) Ltd.'s Properties.

Please provide the following in your Third Party User Request Form:

1. Name and title of organization and/or person requesting permission (prospective "licensee" of Cat & Nat Publishing (Thailand) Ltd.'s Properties), e-mail, phone, fax, and mailing address;
2. Attach sample layout showing proposed use of any Cat & Nat Publishing (Thailand) Ltd.'s Properties;
3. Provide specific description of materials in which Cat & Nat Publishing (Thailand) Ltd.'s Properties will appear, such as type of work, title of the work, name(s) of author(s) and editors of the work, and content of the work. Please note that a sample of the work must be submitted to Cat & Nat Publishing (Thailand) Ltd. prior to Cat & Nat Publishing (Thailand) Ltd.'s approval and authorization for use of its Properties and grant of a License Agreement; and
4. Distribution plans as to which media, territory, how long will copies be offered for distribution and the requested channels of distribution.

I acknowledge that I have reviewed the above terms and that I and my organization will agree to these terms, and any additional terms set forth within Cat & Nat Publishing (Thailand) Ltd.'s approval and/or License Agreement, which terms will collectively govern any use of Cat & Nat Publishing (Thailand) Ltd.'s Properties in relation to this Request.

Claims of Intellectual Property Violations

If you are an intellectual property rights owner, agent, or representative and believe that your copyrighted work and/or trademark has been used in such a way by Cat & Nat Publishing (Thailand) Ltd. that you believe constitutes as infringement, or that your intellectual property rights have been otherwise violated, please provide us with the following information and send it to: name and email address

1. A Power of Attorney or other legal document made under penalty of perjury indicating the name and signature of the person authorized to act on behalf of the intellectual property owner;
2. A trademark certificate and/or copyright recordal showing the name of the intellectual property rights holder;
3. A description of the intellectual property that you claim to have been infringed;
4. A description of where the alleged infringing material is in our online magazine, or, a representative list of copyrighted works or trademarks if multiple copyrighted works or trademarks are being claimed;
5. Your address, telephone number, and email address; and
6. A statement by you that you have a good faith belief that the alleged use is unauthorized by the intellectual property owner or its agent, and violates intellectual property laws.

บริษัท แค็ทแอนด์แน็ท พับลิชิ่ง (ไทยแลนด์) จำกัด (“บริษัท”) เป็นเจ้าของลิขสิทธิ์ในบรรดาเนื้อหาและข้อความ คำวิจารณ์ งานออกแบบ และการจัดเรียงข้อความและภาพประกอบทั้งหมดซึ่งอยู่ในนิตยสารออนไลน์ของบริษัท การใช้ เผยแพร่ หรืออ้างอิงข้อความหรือเนื้อหาของบริษัทโดยมิได้รับอนุญาตหรือความยินยอมล่วงหน้าเป็นลายลักษณ์อักษรจากบริษัทจะต้องระวางโทษในทางอาญา และ/หรือโทษในทางแพ่งภายใต้กฎหมายว่าด้วยลิขสิทธิ์แห่งราชอาณาจักรไทย รวมถึงการชดใช้ค่าเสียหายอันสมควรตามกฎหมายอื่นใดที่เกี่ยวข้อง

นิตยสารออนไลน์ของบริษัทมีวัตถุประสงค์หลักเพื่อให้ความบันเทิง นำเสนอข้อมูลข่าวสาร แลกเปลี่ยนความคิดเห็นและคำวิจารณ์ บริษัทไม่รับประกันหรืออวดอ้างถึงคุณภาพ ประสิทธิภาพ ความปลอดภัย หรือความน่าเชื่อถือของสินค้าและบริการที่ปรากฎอยู่ในบทความและบทวิจารณ์ ดังนี้ บริษัทจะไม่รับผิดชอบต่อคำรับรองหรือความรับผิดทางกฎหมายใด ๆ ในความชำรุดบกพร่อง ผลข้างเคียง หรือความเสียหายใด ๆ ที่เกิดหรืออาจเกิดขึ้นจากการใช้สินค้าและบริการที่ปรากฎในบทความและบทวิจารณ์ดังกล่าว บริษัทไม่ได้ขายหรือส่งเสริมการขายสินค้าหรือบริการเหล่านี้ และมิได้เป็นบริษัทในเครือหรือหุ้นส่วนในบริษัทผู้ขายหรือผู้ส่งเสริมการขายสินค้าและบริการดังกล่าว รวมถึงไม่มีความเกี่ยวข้องในทางใดกับบริษัทใดที่แข่งขันไม่ว่าโดยตรงหรือโดยอ้อมกับเจ้าของสิทธิในเครื่องหมายการค้าหรือเครื่องหมายบริการในสินค้าหรือบริการเหล่านั้น

บริษัทเคารพในสิทธิในทรัพย์สินทางปัญญาของบุคคลอื่นและไม่รับผิดชอบในข้อความหรือในเนื้อหาของบุคคลภายนอกที่ปรากฎอยู่บนเว็บไซต์อื่นที่เชื่อมโยง อ้างถึง หรือใช้ในนิตยสารออนไลน์ของบริษัท เนื้อหาที่ปรากฎอยู่บนหรือผ่านทางเว็บไซต์อื่นอาจได้รับความคุ้มครองตามกฎหมายว่าด้วยลิขสิทธิ์หรือกฎหมายว่าด้วยทรัพย์สินทางปัญญาอื่นของประเทศไทยและ/หรือประเทศอื่น ทั้งนี้ บริษัทไม่รับรองคำโฆษณา สินค้า หรือบริการใด ๆ ที่ปรากฎอยู่บนเว็บไซต์หรือแหล่งที่มาดังกล่าว ดังนี้ บริษัทจะไม่รับผิดต่อความสูญเสียหรือความเสียหายอย่างใด ๆ อันเกิดแก่บุคคลภายนอก หรือการที่บุคคลภายนอกยึดถือในความถูกต้องแท้จริง หรือความมีอยู่ของโฆษณาดังกล่าวและ/หรือเนื้อหานั้น หรือเนื่องมาจากการใช้ประโยชน์จากเว็บไซต์หรือแหล่งที่มานั้น ๆ การใช้งานเว็บไซต์อื่นจะต้องเป็นไปตามเงื่อนไขการใช้งานของเว็บไซต์เหล่านั้น

การร้องเรียนการละเมิดสิทธิในทรัพย์สินทางปัญญา

หากท่านเป็นเจ้าของทรัพย์สินทางปัญญา ตัวแทน หรือผู้แทนของเจ้าของทรัพย์สินทางปัญญาใด และเชื่อว่าบริษัทใช้งานอันมีลิขสิทธิ์หรือเครื่องหมายการค้าของท่านโดยการละเมิด หรือฝ่าฝืนสิทธิในทรัพย์สินทางปัญญาดังกล่าว โปรดแจ้งชื่อ และ อีเมล์ ของท่านมายังบริษัท โดยติดต่อกับ คุณปนัดดา ฉิมตระกูล (บรรณาธิการ) ที่เบอร์โทรศัพท์ 02-676-5005 ต่อ 601 หรือ อีเมล์ info@catandnat.com พร้อมข้อมูลดังต่อไปนี้

1. หนังสือมอบอำนาจหรือเอกสารทางกฎหมายที่มีการรับรองความถูกต้องแท้จริงซึ่งแสดงชื่อและลายมือชื่อของบุคคลผู้ได้รับมอบอำนาจให้กระทำการแทนเจ้าของทรัพย์สินทางปัญญา
2. หนังสือสำคัญแสดงการจดทะเบียนเครื่องหมายการค้า หรือเอกสารรับรองลิขสิทธิ์ซึ่งปรากฏชื่อของเจ้าของทรัพย์สินทางปัญญานั้น ๆ
3. คำอธิบายถึงลักษณะของทรัพย์สินทางปัญญาซึ่งอ้างว่าถูกละเมิดสิทธิ
4. คำอธิบายซึ่งระบุเนื้อหาที่ปรากฏในนิตยสารออนไลน์ของบริษัทซึ่งละเมิดสิทธิในทรัพย์สินทางปัญญาตามที่กล่าวอ้าง และรายการแสดงงานอันมีลิขสิทธิ์หรือเครื่องหมายการค้าที่อ้างถึง ถ้างานอันมีลิขสิทธิ์หรือเครื่องหมายการค้าที่ถูกละเมิดมีหลายรายการ
5. ที่อยู่ เบอร์โทรศัพท์ และอีเมล์ของท่าน
6. ข้อความซึ่งรับรองว่าท่านเชื่อโดยสุจริตว่าการใช้ทรัพย์สินทางปัญญาดังกล่าวเป็นการใช้โดยมิได้รับอนุญาตจากเจ้าของทรัพย์สินทางปัญญาหรือตัวแทน และเป็นการฝ่าฝืนกฎหมายว่าด้วยทรัพย์สินทางปัญญา
7. พร้อมลงวันที่ ชื่อ และลายมือชื่อ หรือชื่อของนิติบุคคล พร้อมตราประทับ (ถ้ามี) ของผู้เรียกร้อง
